WHAT IS A PROBATE?
A Probate case is opened when there is a Will or the decedent died intestate. The court determines the settlement of the decedent’s estate. If there is no Will or Trust, then the estate of the decedent passes by Intestate succession according to the laws of descent. Under Intestate succession, the community property and separate property of the decedent differs as to the division to the surviving heirs.
The beginning of a Probate case is an information gathering process, locating and reviewing the Will, if any, obtaining names and addresses of all heirs, devisees and legatees; locating and examining the decedent’s record to ascertain all of the property and how title is held.
